By accessing or using www.fairwayturfsouthjersey.com (the “Site”) or any services offered by Fairway Turf & Artificial Grass LLC (“Fairway Turf,” “we,” “our,” or “us”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, please do not use the Site.

All content on the Site—text, graphics, logos, photos, videos, and software—is owned or licensed by Fairway Turf and protected by U.S. and international copyright, trademark, and other intellectual-property laws. You may view, download, or print materials for personal, non-commercial use only. Any other use requires prior written consent.

3. PERMITTED USE OF THE SITE
You agree not to:
• Violate any applicable laws or regulations.
• Upload or transmit viruses, malware, or any malicious code.
• Attempt to gain unauthorized access to the Site, servers, or databases.
• Copy, scrape, or harvest content or data for commercial purposes without permission.

4. SCOPE OF SERVICES
Fairway Turf provides synthetic-turf installation, hardscaping (e.g., paver patios, walkways, retaining walls, stairs), landscape lighting, and related design services, including 3-D landscape renderings. The descriptions, photos, videos, pricing, and timelines presented on the Site are for general marketing purposes only.
*Binding obligations arise solely through a separate written contract* (quote, proposal, or service agreement) executed by both parties, which will detail the exact scope of work, schedule, payment terms, and warranty coverage for each specific project.

5. QUOTES, ESTIMATES & ONLINE CONTENT
Any prices or project timelines displayed on the Site are estimates and do not constitute a legally binding offer. Final pricing and contractual terms will be confirmed in a written agreement signed by both you and Fairway Turf.

6. THIRD-PARTY LINKS
The Site may contain links to third-party websites. Such links are provided for convenience only; we do not endorse or assume responsibility for the content or policies of those sites.

7. DISCLAIMER OF WARRANTIES
The Site is provided “as is” and “as available.” Fairway Turf disclaims all warranties—express or implied—regarding the Site’s operation, content, or availability, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Fairway Turf shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of (or inability to use) the Site, even if we have been advised of the possibility of such damages. Our total liability to you for any direct damages shall not exceed one hundred U.S. dollars (US $100).

9. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Fairway Turf, its owners, employees, and agents from and against all claims, liabilities, damages, losses, or expenses (including reasonable attorney’s fees) arising from your violation of these Terms or your misuse of the Site.

10. GOVERNING LAW & VENUE
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law provisions. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Atlantic County, New Jersey.

11. MODIFICATIONS TO TERMS
We may revise these Terms at any time by posting an updated version on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
